1. Introduction
Welcome to QuikBuddy (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our parcel delivery services, including our mobile application and website (collectively, the “Service”). By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Definitions

  • “User,” “you,” or “your” refers to any individual or entity that registers for or uses the Service.

  • “Sender” means the User who initiates a delivery request.

  • “Recipient” means the individual or entity designated to receive the parcel.

  • “Courier” means any third‐party or independent contractor engaged by QuikBuddy to pick up, transport, and deliver parcels.

  • “Parcel” means any package, document, or shipment you request to be delivered through our Service.

  • “Custom Quote” refers to the price estimate generated by you (or by us on your behalf) based on package size, weight, distance, delivery speed, and insurance coverage.

  • “Insurance” refers to the optional coverage you select to protect your Parcel against loss, damage, or theft during transit.

3. Eligibility & Account Registration
3.1 Age Requirement
You must be at least 18 years old to register for a QuikBuddy account or use the Service. By registering, you represent that you meet this age requirement.

3.2 Account Information
When you create an account, you must provide accurate, up-to-date, and complete information. You agree to keep your account login credentials confidential and to notify us promptly of any unauthorized use or security breach. You are responsible for all activity under your account.

4. Service Availability & Scheduling
4.1 Service Coverage
QuikBuddy operates within the geographic regions and time slots displayed in our application or website. We reserve the right to modify service areas or delivery hours at any time without prior notice.

4.2 Pickup Scheduling

  • To schedule a pickup, you must provide:

    • Sender and Recipient names and addresses

    • Contact phone numbers or email addresses

    • Parcel dimensions, weight, and contents description

    • Desired insurance coverage level (if any)

  • Once the pickup is confirmed, we will dispatch a Courier during the selected time window.

4.3 Delivery Expectations

  • Delivery estimates are provided at the time of booking but are not guaranteed. Factors such as traffic, weather, or unforeseen delays may affect timing.

  • We will make every reasonable effort to meet the estimated delivery window but cannot be held liable for delays beyond our control.

5. Custom Quotes & Pricing
5.1 Custom Quote Generation

  • You may request a Custom Quote by entering parcel dimensions, weight, distance, insurance selection, and desired delivery speed.

  • QuikBuddy will calculate a binding quote, which you must accept before confirming the booking.

5.2 Payment

  • All payments are due in full at the time of booking. We accept the payment methods listed in our app or website.

  • By providing payment information, you authorize us to charge the quoted amount plus any applicable taxes and fees.

  • If additional fees arise (e.g., re-delivery attempts, address changes in transit, or oversized parcel surcharges), we will notify you, and you agree to pay such fees before final delivery.

6. Insurance & Liability
6.1 Insurance Options

  • QuikBuddy offers tiered insurance coverage:

    1. Basic Coverage (up to a specified value)

    2. Enhanced Coverage (higher specified value)

    3. Custom Coverage (you declare the full value up to specified maximums)

  • To obtain coverage, you must select the insurance tier or request a custom insurance amount when booking.

6.2 Limits of Liability

  • If you opt for insurance, in the event of qualifying loss, damage, or theft, we will reimburse you up to the insured amount, subject to the exclusions and deductibles outlined in our Insurance Policy (available upon request).

  • If you do not select any insurance, QuikBuddy’s liability for loss or damage to parcels is limited to ₹500 or as required by applicable law, whichever is greater.

  • We are not liable for any indirect, incidental, or consequential damages (including lost profits or business interruption).

6.3 Claims Process

  • To file a claim, you must notify QuikBuddy’s support team within 48 hours of attempted delivery or discovery of damage.

  • You will be required to provide:

    • Booking reference number

    • Photos of the damaged parcel and contents (if applicable)

    • Proof of parcel value (invoices, receipts, or appraisals)

  • We will provide a final determination within 15 business days. Claims may be denied if evidence suggests negligence on the Sender’s part, improper packaging, or prohibited contents.

7. Pick-Up & Drop-Off Confirmation
7.1 Pickup Confirmation

  • At pickup, the Courier will take a timestamped photo of the sealed parcel as proof of collection.

  • You and the Courier may both sign a digital pickup confirmation. A copy will be sent to your registered email.

7.2 Drop-Off Confirmation

  • Upon delivery, the Recipient may be required to sign electronically. A timestamped photo of the parcel at the drop-off location may also be taken.

  • If the Recipient is unavailable at the scheduled delivery time, the Courier will leave a delivery attempt notice with instructions for re-delivery or pickup at a designated location. Additional fees may apply for re-delivery.

8. Prohibited & Restricted Items
8.1 Prohibited Items
You may not ship any item that:

  • Violates applicable local, state, or federal laws (e.g., illicit substances).

  • Is perishable or hazardous (e.g., flammable liquids, explosives, corrosive chemicals), unless pre-approved and routed through a certified specialty courier.

  • Contains firearms, ammunition, or weapons, except where explicitly permitted by local law and by QuikBuddy with advance written authorization.

8.2 Restricted Items

  • Certain high-value items (e.g., precious metals, jewelry) may require specialized packaging and additional insurance. You must notify us in advance if shipping such items.

  • QuikBuddy reserves the right to refuse shipments that pose a safety risk or require special handling without proper prior arrangements.

9. User Obligations & Representations
9.1 Accurate Information
You represent and warrant that all information provided when booking a delivery—especially parcel contents, value, weight, and dimensions—is accurate and truthful. Misrepresentation may result in delivery refusal, claim denial, or additional fees.

9.2 Proper Packaging

  • You are responsible for adequately packaging your parcel to withstand normal handling. If your packaging is deemed insufficient or unsafe, the Courier may refuse to accept the parcel until it is properly packed.

  • QuikBuddy is not liable for damage caused by improper or inadequate packaging.

9.3 Compliance with Laws
You agree to comply with all applicable laws, regulations, and customs requirements. If you fail to do so, you will indemnify and hold QuikBuddy harmless from any fines, penalties, or liabilities arising from non-compliance.

10. Termination & Suspension
10.1 Termination by User
You may terminate your QuikBuddy account at any time by contacting support. Termination does not relieve you of any obligations incurred prior to termination (e.g., unpaid delivery fees or pending claims).

10.2 Termination or Suspension by QuikBuddy
QuikBuddy reserves the right to suspend or terminate your account, cancel deliveries, or refuse service if we believe you have:

  • Violated these Terms.

  • Engaged in fraud, abuse, or illegal activities.

  • Attempted to ship prohibited items.

  • Failed to pay for a booked delivery.
    We will provide notice of termination when feasible. In the event of termination, any in-transit shipments will be delivered or returned to sender at your expense.

11. Intellectual Property
All content, logos, trademarks, and software used in connection with the Service are the property of QuikBuddy or its licensors. You may not copy, distribute, modify, or create derivative works from any portion of the Service without our prior written consent.

12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIKBUDDY AND ITS AFFILIATES, PARTNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

  • LOST PROFITS, REVENUES, OR BUSINESS INTERRUPTION.

  • ANY LOSS OR DAMAGE CAUSED BY EVENTS BEYOND OUR REASONABLE CONTROL (FORCE MAJEURE).
    OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC DELIVERY AT ISSUE (OR ₹1,000, WHICHEVER IS LESS), EXCEPT IN CASES OF GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

13. Indemnification
You agree to defend, indemnify, and hold harmless QuikBuddy and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of:

  • Your use of the Service.

  • Your violation of these Terms.

  • Your failure to comply with applicable laws.

  • Any claim that your Parcel contents infringe or violate a third party’s rights.

14. Privacy & Data Protection
Your use of QuikBuddy’s Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to our collection and processing of personal data as described in the Privacy Policy.

15. Modifications to Terms
QuikBuddy may update these Terms from time to time to reflect changes in our practices, legal requirements, or Service features. When we make material changes, we will notify you via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those changes.

16. Governing Law & Dispute Resolution
16.1 Governing Law
These Terms and any dispute arising under or related to these Terms will be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

16.2 Arbitration

  • Any dispute, claim, or controversy arising out of or relating to these Terms, your account, or the Service shall be resolved by binding arbitration administered by the Indian Council of Arbitration under its rules.

  • The arbitration will take place in Mumbai, India, and be conducted in English.

  • Each party will bear its own costs, and QuikBuddy will pay the filing fee for the first arbitration.

16.3 Small Claims & Injunctive Relief
You may assert individual claims in small claims court in your jurisdiction for disputes or claims within that court’s monetary jurisdiction. Notwithstanding the foregoing, QuikBuddy may seek injunctive or equitable relief in any court to protect its intellectual property rights or to prevent unauthorized use of its Service.

17. Severability
If any provision of these Terms is held invalid or unenforceable under applicable law, that provision shall be deemed stricken, and the remaining provisions will continue in full force and effect.

18. Waiver
No waiver by QuikBuddy of any breach or default of these Terms will be deemed a waiver of any subsequent breach or default. No waiver is effective unless in writing and signed by an authorized representative of QuikBuddy.

19. Entire Agreement
These Terms, together with any documents expressly incorporated herein (including the Privacy Policy and Insurance Policy), constitute the entire agreement between you and QuikBuddy regarding the Service and supersede all prior or contemporaneous communications, representations, or agreements.
